Terms And Conditions

1. Who is Gharpercake.com?

  • Gharpercake.com is an online website for delivering fresh and delicious cakes. This page contains all terms and conditions that stand for all orders placed on this site.

2. Delivery Timings:

  • Orders have to be made before 5 PM for the same day delivery. All orders made after 5 PM shall be considered for the next day delivery.
  • Our regular delivery timings are between 9:00 AM to 7:00 PM. We do not guarntee any timed delivery, clients can request specific timings on our toll free number 8287190190. We will try our best to serve the client's request but cannot commit 100% efficiency in the timing of delivery.
  •  Delivery timings if promised cannot be guaranteed in case of special circumstances like extreme weather conditions, riots, strikes, elections, bandhs, during rush hour days like Valentine's Day, Mothers Day,   Rakhi, New year Eve etc, the order cancellation would not be possible in such circumstances.

3. Discounts:

  • All the discounts are decided by Gharpercake team and none of the Discount and offers can be clubbed together.

4. Address Change:

  • Any changes to the delivery address would not be entertained after 48 hrs of actual delivery and order would not be cancelled.

5. Order Change:

  • Any changes to the order would be entertained if requested before 5 hrs of actual delivery. Changes after the deadline would not be entertained and order would not be cancelled in this scenario.                  

            *There will be cancellation charges of 5% on all cancellation requests.

6. Delivery Product:

  • Due to basic nature of cake making it is not possible to recreate each and every cake exactly as depicted in our picture. Although we make maximum efforts to make a cake as close our picture. It may still be different from the pictures shown on the site.
  • The flower bouqet cannot be guaranteed to be exact same replicas as shown on the site because of different vendors & different season availability. Although the quantity of the product will be the same.
  • If there have to be substitutions because of non availability of products these substitutions will be of equal or higher quality.
  • Change of color of flowers due to non availability shall also be considered under this condition.

7. Complaint deliveries:

  • We will cater to any reports of damaged Cakes/ flowers on the same day of delivery only i.e within 24 hours of delivery. The complaint must be supported with substantial proofs of the product e.g. the photograph of the product or the sample of the product. If there is no valid proof then the complaint would be terminated and there will be no refund.

8. Rules for delivery:

  • If recipient doesn't accept the delivery, we shall consider the order to be delivered and if the order is not paid then Management have the rights to take action. If order is paid then no refund will be made.
  • Gharpercake will attempt the delivery of your product only ONCE. In the event the delivery is not executed during the attempt, the customer shall be charged for the redelivery. We will consider the order executed in the below cases:
  1. Wrong shipping/delivery address.
  2. Recipient not available.
  3. Premises locked.
  4. Wrong landlines / Mobile number or Extension number which may render us unable to reach the recipient for the delivery.
  5. Recipient refusing to accept the delivery.
  6. Delivered the product at the Gate/ Reception/ Neighbor.

        *In above conditions, there will be no refund.

9. Rules for Duplicate Orders:

  • If Gharpercake finds that the same order has been placed more than once, we will try to contact the customer. If the customer is not contactable we will consider the order to be placed only once.

10. Dealing with Fraudulent Customers:

  • If we find out any fraudulent behavior from any client in terms of wrong address, unethical message, odd delivery timings or any other reason, we hold the power to reject that order or ban that customer without being answerable to any one.

11. We hold the right to extend our services to any individual, organization, group or business unit. We may refuse to serve any individual, organization, group or business unit solely on our own will and we will not be answerable to anyone.

12. The final decision is still in the hands of the Management inspite of all the above mentioned terms and conditions.

13. Gharpercake may amend its Terms & Conditions from time to time. These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction.

14. These Terms and Conditions, together with Gharpercake's cancellation and refund policy, Privacy Policy, Disclaimer and other rules and policies posted on the site, which are hereby incorporated as if set forth fully in these Terms and Conditions, constitute the entire agreement between you and Gharpercake with respect to your use of and material available on the site, and they supersede all prior or contemporaneous communications and proposals between you and Gharpercake with respect to this site. Any rights not expressly granted in these Terms and Conditions are reserved.

15. Gharpercake can send transactional and promotional messages on registered phone numbers.
